Okra Stay – Terms and Conditions of Booking and Use

Article 1 – Purpose and Scope

These Terms and Conditions of Booking and Use (the "T&Cs") set out the rights and responsibilities of OKRA STAY Sarl, with a capital of 100,000 dirhams, headquartered in Marrakech at Boulevard Moulay Hassan 1er, Immeuble Sibam, Bloc A, 3rd floor, n°10, registered under number 160517, Tax ID 66215689, and Company ID 003655537000038 (hereafter "Okra Stay"), and any individual or company making a booking through www.okrastay.com or any other affiliated channel (the "Client"). These T&Cs apply to all services offered by Okra Stay, including but not limited to villa rentals, furnished properties, seasonal homes, vehicle rentals (with or without a driver), excursions, activities, personalized experiences, or any related service, as presented on official Okra Stay channels. Okra Stay acts as a contractual intermediary between the Client and the service providers (owners, transport companies, guides, drivers, or other entities delivering the service). The company handles the connection, payment collection, and administrative follow-up of the booking but does not manage day-to-day operations, maintenance, or service delivery. Okra Stay cannot be held liable beyond its intermediary role, including for delays, errors, partial or total non-performance, or any issue caused directly or indirectly by the service provider. The Client confirms they have read these T&Cs before booking and agree to them fully. Making a booking constitutes full acceptance of these terms, which take precedence over any other document not expressly approved by Okra Stay. Okra Stay reserves the right to update, modify, or adapt these T&Cs at any time without notice; changes take effect upon publication on the official site. This document is written in French, which remains the legally binding version. In case of discrepancies between translations, the French version prevails.

Article 2 – Definitions

For clarity, the following terms in these T&Cs, whether singular or plural, have these meanings unless otherwise specified:

Client: Any adult individual or legal entity making a booking or requesting a service through Okra Stay's official channels. The Client confirms they have legal capacity to enter into a contract.
Property or Service: Any villa, property, furnished accommodation, vehicle, excursion, activity, personalized experience, or additional service offered directly or indirectly by Okra Stay or its partners.
Provider: Any individual or entity, including owners, operators, drivers, guides, or companies, directly delivering the booked service. Providers are solely responsible for service quality, safety, and delivery.
Booking: The Client's firm and irrevocable request to reserve one or more services via authorized channels. The booking is confirmed by written confirmation from Okra Stay, provided payment is complete as outlined in Article 4.
Intermediary: Okra Stay, acting exclusively as the contractual link between the Client and the provider, and not as a rental company, transport service, or direct service provider.
Site: The website www.okrastay.com, its subdomains, apps, messaging, forms, or any digital booking tools recognized by Okra Stay.
Force Majeure: Any external, unforeseeable, unavoidable event beyond Okra Stay's control that makes it impossible to fully or partially fulfill obligations, including natural disasters, war, civil unrest, pandemics, strikes, administrative decisions, or major service disruptions. These definitions apply throughout the T&Cs. In case of conflict with other documents, these definitions prevail.

Article 3 – Booking

Bookings must be made through Okra Stay's official channels. Any booking through unauthorized channels is invalid, and Okra Stay may refuse, cancel, or suspend it. A booking is only legally binding once Okra Stay issues written confirmation and full payment has been received.

Clients must provide accurate, complete, and up-to-date information, including personal details, stay information, and any documents required by the provider or law. Okra Stay reserves the right to refuse, modify, postpone, or cancel any booking if the Client breaches these T&Cs, behaves inappropriately or dangerously, commits fraud, or poses a risk to themselves, the provider, or Okra Stay. The Client acknowledges that Okra Stay acts only as an intermediary, and no direct contractual relationship exists with the provider before official confirmation.

Article 4 – Payment

Payment is required to confirm and execute any booking with Okra Stay. The Client must pay the total amount using the method specified during booking, secure payment link, bank transfer, or other approved means. A booking is legally effective only after full payment and written confirmation from Okra Stay. In exceptional cases, and only with Okra Stay's prior approval, payment in cash may be accepted. In such cases, a portion of the amount must be paid before booking, with the remainder due upon arrival. Exact conditions and procedures must be agreed with Okra Stay in advance, and proof of payment must be presented at final settlement. Partial, delayed, incomplete, or unauthorized payments are invalid and may result in automatic suspension or cancellation of the booking, without prejudice to penalties or compensation outlined in these T&Cs. The Client must provide accurate information for payment processing. Okra Stay may charge additional fees, suspend services, or take action to recover outstanding amounts if errors, omissions, refusals, or unjustified opposition occur. Okra Stay is not responsible for issues caused by third-party payment systems, bank delays, or technical failures beyond its control. Payment confirmation from Okra Stay constitutes proof of payment. By paying, the Client accepts these T&Cs and any provider-specific conditions fully, and disputes will only be considered if clear evidence of fraud or error by Okra Stay exists.

Article 5 – Cancellation and Refunds

Cancellation and refund policies are set by these T&Cs and the provider's specific conditions. They are contractually binding.

Villas and similar services: cancellation more than 45 days before arrival → full refund; cancellation within 45 days or no-show → no refund.
Excursions, activities, transport, or vehicle rentals: some services may be partially or fully non-refundable according to the provider's terms. Refunds are made using the original payment method unless otherwise agreed in writing. Okra Stay may retain payments, apply penalties, or charge administrative fees for non-compliance, abusive disputes, or clear fraud. Policies are communicated before booking, and payment confirmation constitutes full acceptance. Disputes must be submitted in writing within 7 days of cancellation or service; otherwise, the Client forfeits any claim.

Article 6 – Security Deposit

For certain services, the guest may be asked to leave a security deposit, which will be clearly indicated at the time of booking. This deposit is meant to cover any damage, missing items or extra charges. It's returned within seven business days after the service ends, as long as no issues are found. If there's any damage or an overage, the corresponding amount will be deducted from the deposit, and the guest agrees to pay any remaining balance within 48 hours after being notified by Okra Stay. For car rentals, security deposits usually range from 400 to 5,000 euros, depending on the type of vehicle. The deposit is a contractual guarantee, and any disputes will be handled in accordance with the General Terms and Conditions and by the competent courts in Marrakech.

Article 7 – Client Responsibilities

Clients must respect the property, facilities, and services, avoid disturbing neighbors, comply with local laws and good conduct. Prohibited: subletting, unauthorized parties, illegal substances, or unapproved pets. Breaches may lead to immediate eviction, deposit retention, and charges for damages or third-party costs.

Article 8 – Check-in / Check-out

Check-in: from 3 PM; Check-out: before 11 AM. Late arrivals incur 700 MAD/hour. Departures after 2 PM incur an extra night's charge.

Article 9 – Liability

Okra Stay is only an intermediary and cannot be held liable for property conditions, provider behavior, third-party actions, or incidents during service. Complaints must be directed to the provider via Okra Stay for administrative follow-up.

Article 10 – Vices, Incidents et Réclamations

Any defect or incident must be reported immediately via WhatsApp or email. Okra Stay will forward and follow up administratively. Late or untimely claims are invalid.

Article 11 – Force Majeure

Sont considérés comme événements de force majeure : catastrophes naturelles, pandémies, grèves, interdictions administratives, ou tout événement imprévisible, irrésistible et indépendant de la volonté d'Okra Stay. Aucun remboursement ne sera effectué en cas de force majeure, mais un avoir nominatif de 12 mois, non cessible et non remboursable, pourra être proposé.

Article 12 – Personal Data

Okra Stay collects and processes personal data in line with Moroccan law n°09-08. Collected data: name, email, phone, payment details, client preferences, and other info from the site. Purpose: booking management, client communication, legal and marketing messages (with consent). Retention: several years. Clients have rights to access, correct, delete, or object via info@okrastay.com. Data may be shared with providers or partners only to deliver the service.

Article 13 – Governing Law and Jurisdiction

These T&Cs are governed by Moroccan law. Disputes fall exclusively under Marrakech courts. Amicable solutions should be sought before legal action.

Article 14 – Acceptance

Payment constitutes full and unconditional acceptance of these T&Cs. The Client confirms they have read, understood, and agree to comply fully.

Data collected directly (name, email, phone, payment info) or indirectly (cookies, analytics). Purposes: booking management, client communication, site analysis, and optimization. Retention: several years. Rights: access, modification, deletion, or objection via info@okrastay.com.
